Privacy Notice

  1. Introduction

We at RunBuggy OMI, Inc. (“RunBuggy,” “we,” “us,” or “our”) know you care about how your personal information is used and shared, and we take your privacy seriously. This Privacy Notice (“Privacy Notice”) describes how RunBuggy collects, uses, shares, and otherwise processes individually identifiable data (“Personal Information”) about visitors and users of our public websites, mobile applications, or any other RunBuggy products or services that are subject to this Privacy Notice (collectively, the “RunBuggy Services”).

This Privacy Notice incorporates our Terms of Service and applies to Personal Information that we collect through the RunBuggy Services, as well as offline through contact forms or other communications with RunBuggy personnel.  Any capitalized terms not defined in this Privacy Notice have the meaning provided in our Terms of Service.

If you are a resident of California, please see the section below titled “Supplemental Notice for California Residents” for additional terms that may apply to you.

  1. What is the scope of this Privacy Notice?

This Privacy Notice applies to all visitors and users of the RunBuggy Services. 

The RunBuggy Services may utilize or contain links and references to other websites or services administered by third parties (“Third-Party Services”). This Privacy Notice does not apply to such Third-Party Services. When you click a link to visit, or otherwise access or use a Third-Party Service, you will be subject to that website’s privacy practices. We encourage you to familiarize yourself with the privacy and security practices of any linked Third-Party Services before providing any Personal Information on that website.

This Privacy Notice also does not apply to Personal Information about RunBuggy applicants for employment, which is collected via a Third-Party Service, or Personal Information about RunBuggy employees, contractors, and other RunBuggy temporary workers, which are addressed through internal company policies and procedures.

  1. What Personal Information do we collect?

RunBuggy only collects Personal Information necessary to provide the RunBuggy Services to you and to maintain our commercial relationship.

We may directly collect the following categories of Personal Information in connection with your use of the RunBuggy Services:

  • Identifiers: name, address, telephone number, email address, age, date of birth, driver’s license number, username and authentication credentials for the RunBuggy Services, IP address.
  • Customer Records: name, address, telephone number, email address, age, date of birth, driver’s license number, username and authentication credentials for the RunBuggy Services, IP address.
  • Commercial Information: products or services purchased, obtained or considered, other purchasing or consuming histories or tendencies, payment information, transaction history.
  • Professional or Employment-Related Information: if you are a Carrier: (i) a copy of your FMCSA Certificate of Operating Authority; (ii) a completed W-9 form; and (iii) proof of insurance.
  • Internet or other Electronic Information: computer Internet Protocol (IP) address; unique device identifier (UDID), e.g., MAC address; Cookies and other data linked to a device; real time location via GPS; and data about usage of the RunBuggy Services and communications. Note, however, we do not consider Device Data to be Personal Information except where we link it to you as an individual or where applicable law requires.
  • Geolocation Information: physical location information through the use of the RunBuggy Services, including precise geolocation information.

We do NOT directly collect the following categories of Personal Information:

  • Credit Card or Financial Data.  RunBuggy does not directly collect or store your credit card number or other payment information, but rather uses a third-party payment processors, Stripe, Inc. and Routable, Inc. (“Payment Processor(s)”), to process payments for the Transport Services as contemplated in the Terms of Service. Accordingly, the applicable Payment Processor will collect your contact information when you pay for Transport Services or receive payment for Transport Services, such as your name, e-mail address, phone number and mailing address. Your billing information is also collected and stored by the Payment Processor. If you are paying by bank debit or credit card, the Payment Processor will collect your credit card number, expiration, three-digit security code and billing zip code. The Payment Processor will share your transaction information with us so that we can track payment status for the Transport Service but will not provide us your card or banking information. The Payment Processor will retain your payment information in encrypted form on its servers. We do not collect or store your card or bank information on our servers.   • Employment Application Data. The RunBuggy Services do not directly collect or store employment application data. RunBuggy’s recruiting website is administered and controlled by Paylocity Corporation (“Paylocity”). Paylocity’s privacy policies can be found at: https://www.paylocity.com/privacy-policy.
  • Sensitive Personal Information. There are certain categories of Personal Information that RunBuggy does not collect. “Sensitive Personal Information” is any data that reveals your racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, or that involves genetic or biometric data or data concerning health or sexual orientation. We do not collect any Sensitive Personal Information from you and ask that you please do not provide Sensitive Personal Information to us if not necessary for us to provide the RunBuggy Services. Please note that we do collect precise geolocation through the RunBuggy Services, which some states consider to be “Sensitive Personal Information.” However, we only use the precise geolocation for the provision of the RunBuggy Services and for no other purpose.
  • Information on Children. Children are not eligible to use the RunBuggy Services. We ask that minors (under the age of 18) do not submit any Personal Information to us or attempt to use the RunBuggy Service under any circumstance. We do not: (i) knowingly collect information from children under 16 years of age; or (ii) have any reasonable grounds for believing that children under the age of 16 are accessing or using the RunBuggy Services. If we learn that we have inadvertently collected Personal Information from a child under age 16, we will delete that information as quickly as possible. If you believe that we might have any information from a child under age 16, please contact us as set forth below.
  1. Where do we collect Personal Information?

We collect Personal Information from the following categories of sources: (i) information you provide to us; (ii) information we collect through automated methods when you use the RunBuggy Services; and (iii) information we collect from third-party sources, such as third-party partners, applications, and other companies or organizations.

  1. How do we use your Personal Information?

RunBuggy uses your Personal Information only: (i) for the purposes stated at the point of collection; (ii) to provide the RunBuggy Services to you; and (iii) to help us improve the delivery and quality of the RunBuggy Services.

We may use Personal Information for the purposes stated or agreed-to (or as is obvious) at the point of collection. For example, we use Personal Information to respond to your questions, comments, or complaints. We may also use Personal Information as requested or consented to by you. We (or our third-party service providers on our behalf) use the above-defined categories of Personal Information for the following purposes:

  1. With whom does RunBuggy share my Personal Information?

RunBuggy will not share your Personal Information except as outlined below.

We may share your Personal Information with the following categories of third-party recipients:

  • Marketing and advertising. We may conduct marketing or advertising campaigns via third party websites and applications (e.g., LinkedIn) (collectively, “Third-Party Platforms”). In those cases, we may disclose your Personal Information to the operators of the Third-Party Platforms solely to allow them to develop marketing campaigns or direct our advertising content to you via the Third-Party Platform.
  • Third-Party service providers. We share Personal Information with service providers to enable such parties to perform functions on our behalf and under our instructions to carry out the purposes identified above, such as our call center, marketing, identity management, payment processing, support services, program development and use, to provide targeted advertising, and web hosting. We require service providers to provide reasonable security for Personal Information and to use and process such Personal Information on our behalf only at our instruction. In the case of our Payment Processors that process credit card payments, we further require them to be PCI-DSS compliant.
  • Auditors and advisors. We share Personal Information with auditors for the performance of audit functions and advisors for the provision of legal and other advice.
  • Business reorganization. We share Personal Information with any corporate purchaser or prospect to the extent permitted by law as part of any merger, acquisition, sale of company assets, or transition of service to another provider, as well as in the event of insolvency, bankruptcy, or receivership in which Personal Information would be transferred as an asset of RunBuggy.
  • Mandatory disclosures and legal rights. We may be required, due to legal or other obligations outside our control, to transfer Personal Information about you to third parties, such as public authorities. In such instances, we share Personal Information to comply with any subpoena, court order or other legal process, or other governmental request. We also share Personal Information to establish or protect our legal rights, property, or safety, or the rights, property, or safety of others, or to defend against legal claims.
  1. What marketing choices do I have?

You may opt out of our use of your Personal Information for direct marketing emails. 

If you no longer wish to receive any marketing email communications from RunBuggy, you can choose to not receive such communications at any time. Please follow the unsubscribe link in the relevant communication or contact us by email with the title “unsubscribe” at security@runbuggy.com.

  1. Do the RunBuggy Services use Cookies?

RunBuggy may use Cookies to help tailor your use of the RunBuggy Services and to optimize and improve the RunBuggy Services.

What are Cookies? We may use cookies, web beacons, pixel tags, and other tracking technologies (collectively “Cookies“) on the RunBuggy Services. A Cookie is a small text file that the RunBuggy Services save onto your computer or device when you use the RunBuggy Services that provides us certain information about your activities. Cookies allow the RunBuggy Services to remember your actions and preferences and recognize you or your browser, along with some information you provided. Web beacons and pixel tags are small graphics on a webpage that monitor your activity when viewing a webpage.

How does RunBuggy use Cookies? We use Cookies to: (i) make the RunBuggy Services function properly; (ii) provide personalized experiences; (iii) tailor our interactions with you; (iv) help with our marketing efforts; (v) provide us with valuable data and statistics about the usage and effectiveness of the RunBuggy Services; and (vi) help us improve the RunBuggy Services.

What information do Cookies collect? Cookies used by the RunBuggy Services may collect: (i) IP addresses assigned to the computers and other devices you use; (ii) your internet service provider; (iii) device ID number; (iv) approximate geographic location; (v) browser type; (vi) websites you access before and after visiting the RunBuggy Services; and (vii) data related to how and when you use the RunBuggy Services. We may combine information from Cookies with other Personal Information.

Google Analytics. We also may utilize Google Analytics, a web analysis service provided by Google, to better understand your use of the RunBuggy Services. Google Analytics collects information such as how often users visit the RunBuggy Services, what pages they visit and what other websites they used prior to visiting. Google uses the data collected to track and examine the use of our websites, to prepare reports on its activities and share them with other Google services. Google may use the data collected on our website to contextualize and personalize the ads of its own advertising network. Google’s ability to use and share information collected by Google Analytics about your visits to our website is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. To learn more about how Google uses data, visit Google’s Privacy Policy and Google’s page on “How Google uses data when you use our partners’ sites or apps.” You may download and install the Google Analytics Opt-out Browser Add-on for each web browser you use. Non-essential Cookies. We may use other non-essential Cookies to display advertising or analyze your use of the RunBuggy Services. Browser-specific guidance on how to manage non-essential cookies, including steps to disable or delete, may be found here for: (i) Google Chrome; (ii) Microsoft Edge; (iii) Mozilla Firefox; and (iv) Safari.

California’s “do-not-track” requirement.  We currently do not honor “do not track” requests. 

  1. Social Media.

We are active on social media, including Facebook, Vimeo, LinkedIn, and Instagram (“Social Media”). Anything you post on Social Media is public information and will not be treated confidentially. We may post (or re-post) on the Services and our Social Media pages any comments or content that you post on Social Media pages. The Services may use advertising networks and services offered by Social Media platforms to deliver advertising content. Use of these services requires Social Media platforms to implement cookies or pixel tags to deliver ads to you while you access the Services. Your use of Social Media is governed by the privacy policies and terms of the providers that own and operate those websites and not by this Privacy Notice. We encourage you to review those policies and terms.

  1. How secure is my Personal Information?

RunBuggy works hard to ensure your Personal Information is secure, but we need you to do your part to help us keep it safe.

We are committed to protecting your Personal Information, and we maintain appropriate technical and organizational measures to protect from loss, misuse, alteration, or unintentional destruction. However, no security measure can guarantee against compromise. You also have an important role in protecting your Personal Information. As set forth in RunBuggy’s Terms of Service, you should not share your username or authentication credentials with anyone. Please ensure that only you have access to the log-in link. Your account is protected for your privacy and security. If you access your account via a third-party website or service, you may have additional or different sign-on protections via that third-party website or service. If you have any reason to believe that your username or account has been compromised, please contact us as detailed below.

  1. The RunBuggy Services are intended for use only in the United States and Canada.

If you access the RunBuggy Services from another country, you understand that United States and Canadian laws will govern our use of your Personal Information.

The RunBuggy Services originate and are intended for use solely in the United States and Canada. This Privacy Notice is intended to cover collection of information through the RunBuggy Services from residents of the United States and Canada. If you are a Canadian resident with a right of access request, please contact us at security@runbuggy.com.

We do not claim that any tools, information or materials made available through the RunBuggy Services are appropriate or may be used outside of the United States or Canada. By using the RunBuggy Services you understand that your information will be transferred to, stored, and processed in the United States where our servers are located, and our central database is operated and will be subject to the laws of the United States.  If you access the RunBuggy Services from outside the United States or Canada, you do so at your own risk.

If you access the RunBuggy Services from outside the United States, please be aware that Personal Information will be transferred to, stored in, and processed in the United States. Certain governmental authorities may not consider the level of protection of Personal Information in the United States to be equivalent to that required by other jurisdictions.

  1. What are the consequences of not providing Personal Information?

You are not required to provide all Personal Information identified in this Privacy Notice to use all of the RunBuggy Services or to interact with us offline (such as via our call center), but certain functionality and services will not be available if you do not provide certain Personal Information. If you do not provide certain Personal Information, we may not be able to respond to your request, perform a transaction with you, or provide you with marketing that we believe you would find valuable.

  1. How long do we retain Personal Information?

We retain Personal Information for as long as necessary to meet the purpose for which we collect it and to fulfill the purposes outlined in this Privacy Notice and as otherwise needed to address tax, corporate, compliance, litigation, and other legal rights and obligations.

  1. How will we handle any changes to this Privacy Notice?

We may update this Privacy Notice from time to time as the RunBuggy Services and privacy practices change, or as required by law. The effective date of our Privacy Notice is posted above. All changes will be effective immediately upon posting to the Services. We encourage you to visit this website periodically to stay informed about our privacy practices. Material changes will be conspicuously posted on the Services or otherwise communicated to you.

  1. Supplemental notice for California residents.

RunBuggy recognizes that residents in California may have additional rights available to them, as described  below.

This section provides additional terms that apply to residents of California. In the event of a conflict between this section and the remainder of this Privacy Notice, this section shall take precedence for California residents.  In this section only, any capitalized terms not defined in this Policy have the meanings set forth in the California Consumer Privacy Act of 2018, as amended, and including its implementing regulations (the “CCPA”).

If you are an employee that is a California resident, please review the California section of the RunBuggy Employee Privacy Notice.

Personal Information collected in the past 12 months. As described in the “What Personal Information Do We Collect” section above, we collect the following categories of Personal Information:

  • Identifiers: name, address, telephone number, email address, age, date of birth, driver’s license number, username and authentication credentials for the RunBuggy Services, IP address.
  • Customer Records:name, address, telephone number, email address, age, date of birth, driver’s license number, social security numbers within a W-9 form, insurance policy number, username and authentication credentials for the RunBuggy Services, IP address.
  • Commercial Information: products or services purchased, obtained or considered, other purchasing or consuming histories or tendencies, payment information, transaction history.
  • Professional or Employment-Related Information: if you are a Carrier: (i) a copy of your FMCSA Certificate of Operating Authority; (ii) a completed W-9 form; and (iii) proof of insurance.
  • Internet or other Electronic Network Activity Information: Computer Internet Protocol (IP) address; unique device identifier (UDID), e.g., MAC address; Cookies and other data linked to a device; real time location via GPS; and data about usage of the RunBuggy Services and communications.
  • Geolocation Information: physical location information through the use of the RunBuggy Services, including precise geolocation (within a radius of 1,850 feet).

Sources. We collect certain categories of Personal Information from you and third parties as described in the “Where do we collect Personal Information?” section above. The categories of third parties from whom we collect Personal Information include the following: (i) third-party partners; (ii) third-party applications (including blogs, chat rooms, or support centers); and (iii) other companies or organizations, such as market research firms or data aggregators. We also receive customer records of your payment transaction through our Payment Processors.

Purposes. We collect the Personal Information for the business and commercial purposes described in the “How do we use your Personal Information?” section above. Please note that we only use precise geolocation information, which is considered Sensitive Personal Information, for the purposes of providing the RunBuggy Services and for no other purpose.

Categories of Third Parties and/or Service Providers. In the last 12 months, we disclosed Personal Information described below to the following categories of third parties:  third party partners, public or government authorities and future business partners.

Sharing your Personal Information for business purposes. As described above in the “With whom does RunBuggy share my Personal Information?” section, we may disclose the following categories of your Personal Information for our business purposes: (i) Identifiers; (ii) Customer Records; (iii) Commercial Information; (iv) Professional or Employment-Related Information; (v) Internet or other Electronic Network Activity Information; and/or (vi) Geolocation Information. As described above, examples of business purposes include product and service fulfillment, internal operations, prevention of fraud and other harm, and legal compliance.

We have not sold or shared Personal Information to any third party in the last 12 months from the date of this Privacy Notice.

We do not have any actual knowledge that we have sold or shared information of any individual under the age of 16 for monetary compensation or for cross-context behavioral advertising.

Consumer Rights. Subject to certain limitations such as: (i) exceptions permitted by applicable law; and (ii) verification of your identity, California residents may exercise the following rights with regard to their Personal Information:

  • Right to request disclosure of categories. California residents have a right to request access to the following information: (a) the categories of Personal Information we collected from you in the 12 month period prior to your request; (b) the categories of sources from which the Personal Information was collected; (c) the business or commercial purpose for collecting your Personal Information; (d) the categories of third parties with whom we disclosed your Personal Information; and (e) the categories of Personal Information we disclosed in the 12 month period prior to who your request. California residents also have a right to access a list of categories of Personal Information we sold or disclosed for a business purpose in the last 12 months, if any.
  • Right to request access. California residents have a right to request that we disclose to you the specific pieces of Personal Information that we have collected about you in the 12-month period prior to your request and receive a copy of your electronic Personal Information in a readily usable format.
  • Right to correct inaccurate data. California residents have a right to request the correction of Personal Information we collected about you. 
  • Right to deletion. California residents have a right to request that we delete Personal Information we collected from you. We will comply with such request, and direct our service providers to do the same, subject to certain exceptions permitted by applicable law.

How to Exercise Rights. As set forth below, you or your authorized agent may exercise these rights by contacting us via email at security@runbuggy.com with the subject line “data subject access request.”

Right to Non -Discrimination. California residents have the right to not receive discriminatory treatment for exercising any of their rights under the CCPA. Should you wish to exercise any of your rights as detailed above, we will not discriminate against you by offering you different services based solely upon your exercise of the above rights.

Verifiable Request. You may make a request to exercise your rights on behalf of yourself, or a parent or legal guardian may make a request on behalf of their child, by contacting us via email at security@runbuggy.com with the subject line “data subject access request.” In order to verify your request, you must provide sufficient information to allow us to reasonably verify you are the person about whom we collected Personal Information, and you must describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to your request. This information may vary depending on the Personal Information we already have. We will only use Personal Information we collect during the verification process for the purpose of verifying your identity.  If you maintain an account with us, we may use that account to respond to your request and/or verify your identity.  If we are unable to verify your identity as required by applicable laws and regulations, we will decline to comply with your request, and let you know why.

Authorized Agent. You also have the option of designating an authorized agent to exercise your rights on your behalf. If an authorized agent contacts us to exercise the above rights, we will need to verify their identity as well as your identity. We will also require proof of your written authorization to the agent to be your agent and to make the specific request submitted, unless the agent is subject to a Power of Attorney under California probate laws. If the agent is a Power of Attorney under California probate laws, we may require evidence of that status.
